Terms & Conditions

Last updated: September 2026

1. About these terms

These Terms & Conditions govern your use of the ProDco building-plan compliance platform (the "Service"). The Service is provided by ProDco ("ProDco", "we", "us"), and by using the Service you are contracting with ProDco. By accessing or continuing to use the Service you agree to these terms.

You confirm that you are of legal age, or that you have authority to bind the organisation on whose behalf you register a firm account.

2. The Service

ProDco provides automated pre-screening of building plans against South African municipal zoning schemes and SANS 10400 requirements, including missing-document checks and clause-cited compliance reports. Reports are decision-support only and do not replace the official approval of any municipality or competent authority.

3. Payments and subscriptions

Paid firm subscriptions are billed monthly. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew monthly until cancelled. You may cancel at any time; access continues until the end of the current billing period. See our Refund Policy for refund terms.

4. Acceptable use

You must not misuse the Service, including by:

  • using the Service for any unlawful purpose, fraud or spam;
  • infringing the intellectual property rights of others;
  • interfering with the security of the Service, including introducing malware, probing, scanning or scraping the platform;
  • reverse engineering, reselling, redistributing or circumventing technical limits of the Service.

You are responsible for the accuracy of the plans and data you submit, for verifying the outputs of automated checks before relying on them, and for ensuring you have the rights to any content you upload.

5. Accounts and credentials

You must keep your account credentials confidential and are responsible for all activity under your account. You must provide accurate information and keep it up to date.

6. Intellectual property

ProDco retains all ownership of the Service and its intellectual property, including software, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You retain ownership of the plans and documents you upload; you grant us a limited licence to host and process that content solely to provide the Service. Rights holders may contact us to request removal of infringing content; repeated infringement may result in termination.

7. Service level and warranties

The Service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free performance, and we disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law. Automated compliance outputs may be inaccurate and must not be relied on as a substitute for professional or official review.

8. Limitation of liability

To the fullest extent permitted by law, our aggregate liability to you is capped at the fees you paid in the 12 months preceding the claim, and we exclude liability for indirect, consequential or special damages (including loss of profits, data or goodwill). Nothing in these terms excludes liability for fraud, death or personal injury where such exclusion is not permitted by law.

9. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination your access ends; you may request an export of your data within 30 days, after which it may be deleted.

10. General

These terms are governed by the laws of South Africa. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for failures caused by events beyond our reasonable control. If any provision is found unenforceable, the remainder continues in effect.

Questions about these terms can be sent to us via the contact details on our website.
